PENSION  COURT  CASE

 

Our Court case started at10.00 AM on April 26 and ended about 2:00 PM on

May 7.  Judge Ted Zarzeczny  was overseeing the case.  Over the course of the 2 weeks,

our case included 2 days of “read – ins” from the Discovery of Brian Smith along with

hundreds of documents and the testimony of 3 witnesses namely the Plaintiffs Alf

Zimmerman, Ron Reavely and Frank May. 

The Government case included many documents and pamphlets, a slide show and

the testimony of  7 witnesses, namely

-          Rod Grabarczyk – of the Provincial Audit

-          Ken Orr – retired Chair of the Sask. Superannuation Board

-          Brian Smith – Assistant Deputy Minister of Finance

-          Dan Perrins – retired Deputy Minister to the Premier

-          Steve Pillipow – retired Sask. Highways Personnel Officer

-          Tor Veltheim – former employee of the PSC

-          Ralph Gilbert – former Finance employee

The Governments case rested completely on the “Legislation” as being the total guiding

document respecting “Pensions”.

         On the other hand our lawyer acknowleged the importance of the legislation but

also argued that the government as an employer had a contract with each employee and

breached that contract with respect to our pensions.

          In the course of the trial, we were quite happy as to how it all was handled and the

information and inputs that were made. We believe our case was well made and that the

testimony of the Government witnesses  turned out, on “cross examination”,  to be more

supportive of our position than the position taken by the Government.

         In closing the case,the judge cautioned that he had an enormous volume of

information provided to him in this most “Unique” case and that it would take some time

until he rendered a decision.

         We do not expect the Judges decision prior to Fall.

       Our Legal costs of this undertaking  will approximate $600,000.00.  Contributions to

the legal fund to this date approximate $350,000.00.  As can be seen from these figures,

we need additional contributions.  Keep in mind that all retirees are already benefiting

from this law suite by way of the 70% indexing we already achieved and have been

receiving in our pension checks since April, 2007.  Please make a contribution so we can
