Legal Claim UPDATE - March 31, 2008


 

 

 

 
The process of discovery, where the SRA lawyer seeks to obtain information from the Government to support our Claim, has now ended.  On March 7, 2008, the last face to face questioning of Mr. Brian Smith, the Government's designated person, to answer these questions and provide information, took place.  While Mr. Smith was not able to provide answers to every question, he did undertake to provide answers to as many of the questions he could and as soon as possible.  Our lawyers agreed that any further information could be exchanged via letter or email and that further face to face meetings with Mr. Smith and the Government lawyer would not be required.
 
In the course of this last discovery with Mr. Smith, we were advised that the Government lawyer, Mr. Don McKillop, was retiring and a new Government lawyer would be assuming responsibility for the case.  The Government has now appointed Mr. Darryl Brown as their legal representative.  He now wishes to once more go through the discovery process with SRA's three Plaintiffs, namely, Frank May, Ron Reavley and Alf Zimmerman. We anticipate that these Discoveries will take place in early April.  Once this is completed the next step is a pre-trial Conference with the judge, leading to
-        negotiations or
-        trial
As you can see the lawsuit is moving ahead, albeit slower than we would like. 

BUT the end is in sight, so don't  lose Heart, WE WILL PERSEVERE.
 
At the same time we are still hoping the current Government will sit down with us to negotiate the issues we have presented to them, so as to avoid the matter having to be dealt with by the courts.
